Giveaway Period Dates:

The giveaway begins on Monday, July 28 at 8:00 AM Eastern Time (“ET”) and ends at 12:00 PM Eastern Time on Friday, August 1 (“ET”) (the “giveaway period”). The sponsor’s computer, or that of its designee, runs the official clock for the ‘giveaway period’ and will solely determine the time by which an entry is received.

Eligibility:

The ‘giveaway period’ is only open to legal residents of the United States, who are eighteen (18) years of age or older at the time of entry and have an Instagram account (“you” or entrant”) prior to the beginning of the giveaway period. Each entrant by participating during the ‘giveaway period’ agrees to be bound by the official rules and that of the sponsor’s decisions. Void outside of the United States and where prohibited or restricted by law. The ‘giveaway period’ is subject to all applicable federal, state, and local laws and regulations.

How to enter:

To enter during the ‘giveaway period’, log into your Instagram account. By submitting your information and using your Instagram account, you agree to the Instagram terms of use and privacy notice. If you do not agree to such terms of use and privacy notice, please do not participate in this giveaway.

Instagram Entry Requirements:

Your privacy options on your Instagram account must be set “public”. One entry per Instagram account during the ‘giveaway period’ via the @azizalyons in-feed post. Multiple accounts may not be used, and anyone found to use multiple accounts to enter will be ineligible.

Entry limit:

One (1) entry per person per account per post. The maximum entries per person per account during the ‘giveaway period’ is one (1). Entries received in excess of the entry limit stated herein will be disqualified. If the sponsor determines that the content of the entry is obscene, offensive, or inappropriate, the entry will not be eligible for any prize consideration and may be withdrawn from the giveaway at any time at the sole discretion of the sponsor. Each entry submission must be manually key stroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including, but not limited to, entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these accounts or related e-mail or IP addresses may be blocked. By submitting an entry, entrant agrees to comply with the giveaway rules. Entries may only be submitted by a single entrant. Entries that do not comply with these giveaway rules, as determined in sponsor’s sole discretion, will be disqualified from the giveaway. Decisions of the sponsor is final and binding.

Random Drawings:

A random drawing to select the prize winners will be conducted at the end of the ‘giveaway period’ (the "drawing date") from among all eligible entries received during the giveaway period. All drawings will be conducted by the sponsor. Decisions of the sponsor will be final and binding on all matters relating to this giveaway.

Prize:

There will be a total of one prize winner during the ‘giveaway period.’ The prize only includes: 2 tickets to a Cincinnati Open single session. The date and session will be at the sole discretion of the sponsor. The tickets are valued at USD $167 each, the total value is approximately USD $330.

It is the prize winner’s sole responsibility to arrange for any travel, parking or other expenses to attend the open. The prize only includes the 2 tickets and nothing else.

The odds of winning a prize depends upon the total number of eligible entries received during the prize period. In no event will more prizes be awarded than those listed in these giveaway rules. 

Winners are responsible for the payment of any and all taxes on the prizes. All details of the prize not specified herein shall be determined solely by sponsor and prize provider. Except as provided herein, no cash or prize substitution is allowed. If prize cannot be awarded due to circumstances beyond the control of sponsor, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prize is awarded but unclaimed or forfeited by recipient, an alternate winner will be chosen at random from the remaining eligible entries, in sponsor’s sole discretion. By accepting prize, prize winner acknowledges compliance with these rules.

Winner Notification and Verification:

The sponsor will contact the potential winner through the entry platform used to submit their entry. Notification will occur by direct message to the potential winner's Instagram account. Winners will be notified on or about the drawing date. The potential winner will be required to respond to the direction in the message within 5 hours with full contact information. Potential winners may be required to complete, sign, and return an affidavit of eligibility and liability release and; where legal, a publicity release (collectively the “affidavit”). Complete document must be returned within one (1) day from prize notification date or the prize will be forfeited and awarded to an alternate potential winner. If a potential winner (i) cannot be contacted after a reasonable attempt has been made by sponsor; (ii) fails to timely return the required paperwork without alteration and in the form presented by sponsor; (iii) refuses the prize; and/or (iv) the prize or prize notification is rejected or returned as undeliverable, such potential winners forfeit all rights to be deemed a winner in the ‘giveaway period’ and receive the prize, and that potential prize winner will be disqualified and an alternate winner will be selected through a random drawing by the sponsor from the remaining entries. Prizes must be accepted as awarded. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the sponsor to use said winner’s name, photograph, likeness, statements, and biographical information without further compensation.

To accept the prize, winner will be required to follow instructions to accept the ticket transfer via email which will further require a Ticketmaster account and a Cincinnati Open account.

Conditions of Entry:

Use of any automated entry software is prohibited. Electronically reproduced, mechanically reproduced, illegible, incomplete or inaccurate entries are void. By participating, entrants agree to comply with these sweepstakes rules including all eligibility requirements. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder from which the entry is made. Caution: any attempt by an entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of this sweepstakes may be a violation of criminal and civil laws and should such an attempt be made; the sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these sweepstakes rules shall not constitute a waiver of that or any other provision.

Limitation of Liability:

By participating during the ‘giveaway period’ each week, entrants agree to release, indemnify and hold harmless releasees and each of their respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the giveaway or acceptance, possession, use, misuse or nonuse a prize (including any travel or travel-related activity thereto) that may be awarded. These giveaway prizes and these giveaway rules shall be interpreted in accordance with the laws of the state of Ohio, without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within the state of Ohio. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the giveaway, including, without limitation, errors which may occur in connection with the administration of the giveaway, the processing of entries, the announcement of the prizes or in any giveaway related materials; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries or; for electronic, computer, or telephonic malfunction or error, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, or process any transaction thereon. If in the sponsors’ opinion, for any reason this sweepstakes is not capable of running as planned, or there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the giveaway, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the giveaway, the sponsors reserve the right at their sole discretion to disqualify any individual (and void his/her entry and/or prevent him/her from future participation) who tampers with the entry process and/or who is acting in violation of these giveaway rules, to modify or suspend the giveaway, or to terminate the giveaway and at sponsor’s discretion conduct awarding of the prize using all eligible non suspect transactions and entries received as of the termination date. As a condition of entering the giveaway, entrants agree that: a.) Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) All causes of action arising out of or connected with this giveaway, or the prizes awarded, shall be resolved individually, without resort to any form of class action; and c.) Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event shall entrant be entitled to receive attorneys’ fees or other legal costs. Sponsor reserves the right to modify prize award procedures at their discretion.

Privacy:

Information collected from entrants is used only for the purpose of awarding prizes, operating the giveaway consistent with the giveaway rules and to notify winners, and will not be re-used, sold or shared in any manner by sponsor or any third parties unless entrant has opted-in to receive additional information and promotional material from sponsor or a third party. Once the giveaway, including any known or unknown extensions of the giveaway has ended, all information supplied by entrants will be removed from the database.
